Federal Agent Shooting Suspect Pre-Trial Delayed to July

A former optician is charged with attempted murder in connection with a Feb. 7 shooting that injured a Newark resident who works as a U.S. Customs and Border Protection officer.

The pretrial hearing for a former Union City optometry teacher charged with the attempted murder of a federal agent who lives in Newark was delayed Thursday morning at the request of his attorney.

Public Defender Barbara Thomas asked that the hearing be pushed to July as a result of outstanding evidence that she has yet to review, she announced in a Fremont courtroom.

Dennis Bagwell, 61, faces charges of attempted murder and assault with a firearm in connection with a that critically injured U.S. Customs and Border Protection officer Robert Smith, whose last name has also been identified as Suplik in several media reports.

Bagwell to those charges on March 9.

Authorities have not released information about possible motives but in Newark police reported that Bagwell had been in contact with Smith’s wife , Iryna Smith, who had been a student at where Bagwell taught.

Those court documents also include a statement in which Bagwell’s daughter said she believed Bagwell “was trying to drive a wedge between the woman and her husband.”

According to the San Francisco Chronicle, Bagwell, who was a licensed optician, had once operated Redwood City Optical. At the time of his arrest, he was a property manager of an apartment complex at the Piedmont-Oakland border.

Bagwell is scheduled for further pretrial on July 13 at 9 a.m. at the Fremont Hall of Justice.
