Former Cattlemen's Off Chopping Block—for Now

Property owners seek compromise, delaying the public hearing on demolition of the former steakhouse until July.

The public hearing on demolition of the former Cattlemen’s restaurant at Jarvis Avenue and Newark Boulevard has been postponed.

The public hearing, originally on yesterday's city council agenda, was rescheduled for the council’s July 14 meeting.

City Manager John Becker said at Thursday’s council meeting that Imwalle Properties requested the deferment because of a disagreement with another property owner within the same shopping plaza.

The owner of the lot expressed concern, stating that the proposal from Imwalle Properties does not comply with the shopping center’s covenants, conditions and restrictions, according to documents provided in the council's June 23 agenda packet.

Becker said that the two property owners of the lots in Rosemont Square are currently seeking a compromise.

The proposal made by Imwalle Properties includes plans to build a 4,360-square-foot building that would provide a drive-through service and a separate 6,640-square-foot building for an AutoZone, a retail auto parts store.

A store sits within the same plaza off Cedar and Newark boulevards.

In comments to Newark Patch Thursday, many residents said they prefer to not have another auto parts store located in Rosemont Square.

They offered a number of options through their comments, including another restaurant – either drive-through or sit-down – an organic grocery store or other retail stores such as a pet supply store or bookstore.

Also at Thursday’s meeting:

  • City council approved the ’s request to participate in a consolidated dispatch study in partnership with the cities of Fremont and Union City. DELTAWRX Management Consultants will conduct the study.
  • The city council voted to declare its intent to abandon its rights to a portion of Mowry School Road as requested by Balentine Drive Holdings, LLC, property owners of 5633 John Muir Dr.
  • All items on the consent agenda were approved.
  • The council authorized a conditional use permit to the Tri-Cities League of Volunteers for Circus Vargas, a fundraising circus to be held July 21-25 at the parking lot southwest of Burlington Coat Factory.
  • The City of Newark honored as a dance instructor for Newark. Newark Patch will publish a separate report on her commendation in the near future.
